Complete Checklist: Getting Married Abroad from Cork

Every document you need — from freedom to marry certificates to apostilles and translations.

Getting married abroad is a dream for many Cork couples — whether it is a sun-drenched ceremony in Italy, a beach wedding in Greece, or an intimate celebration in a French château. While the romance is easy, the paperwork requires careful preparation. Different countries have different legal requirements, and having your documents properly notarised and apostilled is essential for your marriage to be legally recognised.

Understanding the Requirements

Every country has its own marriage laws and documentary requirements. However, most countries require proof that you are:

  • Legally free to marry — not currently married to someone else
  • Of legal age — 18 in most jurisdictions
  • Who you say you are — identity verification

Documents from Ireland must typically be notarised by a Notary Public, apostilled by the Department of Foreign Affairs (for Hague Convention countries), and translated into the local language by a sworn or certified translator.

✅ Core Documents

  • Certificate of Freedom to Marry (also called Certificate of No Impediment or Nulla Osta) — obtained from the civil registration service at your local HSE office; apostille required
  • Birth certificate — long-form, from the General Register Office; apostille required
  • Valid passport — and notarised copies
  • Proof of address — utility bill or bank statement

✅ If Previously Married

  • Divorce decree — final order, apostilled
  • Death certificate of former spouse (if widowed) — apostilled
  • Annulment decree (if applicable) — apostilled

✅ Country-Specific Requirements

Italy

  • Nulla Osta (Certificate of No Impediment) — must be issued within 3 months
  • All documents translated into Italian by a sworn translator
  • Civil ceremony performed by the local mayor (sindaco) or delegate
  • Banns may need to be published at the local comune

Spain

  • Certificate of Freedom to Marry — apostilled and translated
  • Birth certificate — apostilled and translated
  • Certificate of residence (Certificado de Empadronamiento) may be required
  • Civil ceremony at the local registry office (Registro Civil)

Greece

  • Certificate of No Impediment — apostilled and translated into Greek
  • Birth certificate — apostilled and translated
  • Passport copies
  • Some municipalities require a notice period

France

  • Certificat de Coutume — a certificate explaining Irish marriage law; prepared by a solicitor or notary
  • Certificate of Celibacy (Certificat de Célibat)
  • Birth certificate — issued within 6 months, apostilled and translated
  • Banns published at the local mairie at least 10 days before

Portugal

  • Certificate of No Impediment — apostilled and translated
  • Birth certificate — apostilled and translated into Portuguese
  • Proof of residence

✅ Religious Ceremonies

If having a religious ceremony abroad, you may also need:

  • Baptismal certificate — issued within 6 months (for Catholic ceremonies)
  • Confirmation certificate
  • Letter of Freedom — from your parish priest
  • Pre-marriage course certificate

✅ Pre-Nuptial Agreements

Some countries (particularly civil law jurisdictions like France) have specific matrimonial property regimes. You may want to consider:

  • Pre-nuptial agreement — notarised and potentially registered in the destination country
  • Consult both an Irish solicitor and a local lawyer in the wedding country

✅ After the Wedding

  • Foreign marriage certificate — obtain multiple certified copies
  • Apostille the foreign marriage certificate — for use in Ireland
  • Translate the foreign certificate — if not in English
  • Update your records — passport, bank, employer, Revenue

Timeline: When to Start

  • 6 months before: Research destination country requirements, book venue
  • 3-4 months before: Apply for Certificate of Freedom to Marry, order birth certificates
  • 2 months before: Book notarisation appointment, apply for apostilles
  • 1 month before: Commission sworn translations, confirm all documents are ready
  • 2 weeks before: Make copies of everything, carry originals in hand luggage
